I, the Selected Entrant identified above, am the selected entrant for the Prize in the Contest. I understand that I have been offered a prize as stated on www.purdys.com/easter-gift-guide. if I correctly answer the mathematical skill-testing question above, complete this Declaration and Complete Release and Waiver of Claim and otherwise comply with the Official Rules (defined below), and that at that point I will be the Contest winner (the “Winner”).
I, in consideration of being selected as the Selected Entrant, hereby confirm and agree as follows that:
1. I have received, read, understood, complied with and will comply with the rules and regulations related to the Contest (the “Official Rules”) and have answered the skill testing question above in the manner prescribed.
2. My participation in the Contest is subject to the Official Rules.
3. I am at least 18 years of age of majority in my province of residence and my parent/guardian has consented to my entry in this contest. Neither I nor any member of my immediate family is an employee of Purdys;
4. By participating in this contest, I agree to the use by Purdys Chocolatier of my first name, last initial, city, and province of residence on the contest page and in promotional materials, without further compensation, as part of my participation in the Contest and acceptance of the Prize. I understand that this consent is required as a condition of winning.
5. I verify the mailing address provided above, where the prize will be sent to, is a Canadian address (outside of the province of Quebec).
6. I release, indemnify and forever discharge Purdys and their affiliates, officers, directors, employees, agents, representatives, contractors, sub-contractors, consultants, advertising and promotional agencies, and their respective officers, directors, shareholders and employees, and the independent judging panel (hereinafter collectively referred to as the "Releasees") from, and waive as against the Releasees, all recourses, losses or damages including any consequential losses or damages, actions, causes of action, suits, debts, dues, accounts, bonds, covenants, contracts, claims and demands whatsoever including, without imitation, any claim based on the loss of ability to earn income, claims for injury, death, illness, delay or cancellation arising out of the Prize (hereinafter collectively referred to as "Claims"), which I now have or hereafter can, shall or may have for or by reason of or in any way arising out of this Contest including, without limitation, any Claims arising out of my subsequent use of the Prize, whether such Claims arise in contract, by reason of negligence, or by reason of breach of duty raised by statute or in any other manner whatsoever.
7. The provisions of this Declaration and Complete Release and Waiver of Claim shall ensure to the benefit of the respective heirs, executors, administrators, legal personal representatives, successors and assigns of the Releasees and shall be binding upon my heirs, executors, administrators, legal personal representatives, successors and assigns.
8. The provisions of this Declaration and Complete Release and Waiver of Claim shall be
governed by and interpreted in accordance with the laws of the Province of British Columbia and I irrevocably attorn to the jurisdiction of the courts of the Province of British Columbia.
9. I agree to return immediately upon demand to Purdys any Prize or the value of such Prize, which has been awarded to me if any statement made by me in this Declaration and Complete Release and Waiver of Claim is false.
10. I have read the contents of this Declaration and Complete Release and Waiver of Claim, and I fully understand and agree to all of its provisions. I have had the opportunity to seek independent legal advice, and in the event I did not avail myself of that opportunity, I did so voluntarily and without any undue pressure and I agree that my failure to obtain independent legal advice may not be used as a defense to the enforcement of this Declaration and Complete Release and Waiver of Claim.
NOTICE: By signing this document, you give up certain legal rights. This document contains a complete release and waiver of claims - read completely before signing. You also understand and agree taht by signing this document you are acknowledging full compliance with the Official Rules.
